What Documents can be notarised online?
Online notarisation is available when it is the document that I am verifying rather than a signature or identity and capacity.
This applies to education certificates, Birth, Death and Marriages Certificates, Decree Absolutes and Company Documents. Commercial licences and Tax certificates are also verifiable online and so can be notarised remotely. This list is not exhaustive, and each document and situation is considered on its own merits.
What documents will you not notarise remotely?
Affidavits and Statutory Declarations must always be made in the physical presence of the person taking the oath.
Deeds such as powers of attorney must always be signed in the physical presence of the witnesses and the Notary.
Why can you not see me via video call?
This is because I am not just witnessing your signature. I am verifying your identity, linking you to the document, assessing your mental and legal capacity and assessing matters such as fraud, duress and your freedom and willingness to enter into the legal document. The only way that this can be done effectively and safely, is to see you in person. This is for the security of the document and your protection.
On occasion, some documents other than deeds, affidavits and statutory declarations may be notarised remotely where I have met you and witnessed your signature on previous occasions. Each matter would be considered on its own merits.
Is there anything else that I should be careful about?
I completely understand that a remote notary service may appear to be the easy and cheap option. However, you should always consider whether the remotely notarised document will be accepted by the receiving jurisdiction.
The Foreign Commonwealth and Development Office will only Apostille documents that have been notarised by a UK Notary Public. If in doubt, check that the remote notary is registered with the Faculty Office here;
